Settling Your Criminal Injury Case
For obvious reasons the settlement of their claim is usually the most important priority for those who have chosen to bring a claim for personal injury compensation.
If someone has chosen to pursue a claim for personal injury compensation then the two main questions they usually want answering are as follows:
How long is it going to take?
This is almost impossible to answer accurately at the outset of a claim. We can tell you that the insurers to whom your claim is directed will have 21 days to acknowledge the first letter we send to them instigating your claim (this is called a “letter of claim”) and then a further 3 months after that for them to investigate the claim and confirm to us whether they will accept liability for your accident or deny liability. Beyond this guideline each case is individual and to a very large extent the amount of time it will take us to reach the point of settling a case depends on the factors unique to that case. For example, should the insurers accept liability for your accident then you can expect that your claim will be moved toward settlement quicker than if liability is denied. Each case is different and you will be given specialist advice relevant to YOUR case when you instruct Whitestone Solicitors to bring a claim for personal injury compensation on your behalf.
How much compensation will I get?
Again there is very little basis at the start of a claim for us to be able to provide you with an accurate assessment of precisely how much compensation you will be entitled to were your claim to succeed. This is because we need to assess not only what the injuries consist of but how they affect an individual on a daily basis and how long it will take that individual to make a full recovery, if at all. There are numerous other factors which any settlement figure has to take into account and it will be apparent already that it is simply just not practical or possible to do this at the start of a claim.
Any settlement is likely to be based on medical evidence obtained by Whitestone Solicitors on your behalf and/or the insurers against whom the claim is being brought. You will appreciate that until all the necessary medical evidence is in place we will not be able to accurately assess just how much personal injury compensation you should be entitled to and what settlement figure would be a fair assessment for the injuries you have suffered.
